My partner put a deposit on a car last week in an independant garage. When she read through the ad it mentioned nothing about the colour being extremely faded though when she asked this question in the phone to them they said the colour was fine and it was the lights in the showroom! The garage was over 200miles away so we could not view the car straight away so my partner left a deposit and said she would be up the following weekend. When we got there the car didn't have a panel that wasn't faded and the sale guy who spoke to my partner on the phone, accused my partner of lieing and that she had not asked about the colour and that she would not get a refund. She asked to speak to the manager and was told, even though he was available to the sales guy on the phone, that he wasn't available on the weekend. My partner even offered to still accept the car if they came down on price to cover the cost of remedying the paint issue. She paid the deposit by debit card and had no written receipt off the garage for it. Can she get her money back??
